APPLICATION, VARIATION, AND TERMINATION OF THESE TERMS AND CONDITIONS
1.1. These Terms and Conditions govern the services provided by Overton Corporation PTY LTD, which will henceforth be referred to as “Overton Solutions”, through our online platform.
1.2. Any use of the Overton Solutions platform by you constitutes acceptance of these Terms and Conditions.
1.3. Overton Solutions may at any time, in its sole discretion, amend, vary, or modify these Terms and Conditions without notice.
1.4. Modifications to these Terms and Conditions will be effective immediately upon being posted on the platform. Any subsequent use by you of this platform will constitute your acceptance of the modifications and the then-current terms and conditions of use of this platform.
1.5. Overton Solutions may, without notice, terminate or suspend this platform or any part of the platform at any time.
Privacy and Data Use
2.1. Any personal information received by Overton Solutions will be collected and disclosed in accordance with Overton Solutions’ Privacy Policy, which is updated from time to time and available on our website.
2.2. Our services use a third-party email proxy service to send emails on behalf of users. Recipients of emails sent from our platform may reply to these emails, but such replies do not constitute direct communication from Overton Solutions to the user.
2.3. The third-party email proxy service will retain users’ data only as long as necessary to send the emails. This service may hold “random content samples,” which could include personal information, for anti-fraud purposes for a maximum of seven days. Overton Solutions and its clients using the activism platform do not have access to or control over this process.
2.4. For legal reasons, the third-party service may retain personal data for up to one year. This retention is strictly for legal compliance and is not used for marketing purposes. It will not impact the user experience, including if a user opts to unsubscribe from a mailing list or requests their data be removed from a database.
Consent for Promotional Materials
3.1. By using the service and providing your information, you explicitly consent to receive promotional and informational materials from Overton Solutions and the client using the service (CHERISH LIFE QUEENSLAND INC), in accordance with the Spam Act 2003. You have the right to opt out of receiving these communications at any time.
Use of Information
4.1. We use the personal information you provide to us to facilitate communication with elected representatives, send you service-related notifications, and provide the service.
Data Breach Notification
5.1. In the event of a data breach that is likely to result in serious harm to the individuals whose personal information has been compromised, Overton Solutions will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches (NDB) scheme under the Australian Privacy Act 1988.
Limitation of Liability
6.1. The service is provided on an “as is” and “as available” basis. Overton Solutions does not exclude any warranties or conditions that are implied by law, and if any term, condition, or warranty is implied by law and cannot be excluded, then it is included in these Terms and Conditions.
Intellectual Property
7.1. Intellectual property rights in the content on this platform, including any copyright, trademark rights, vest in Overton Solutions, subject to any third-party rights.
7.2. Nothing contained on this platform is to be construed as granting a license to use any content on this platform. You may not use, reproduce, or modify any content displayed on this platform without our written consent.
Governing Law
8.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any dispute arising under these Terms and Conditions shall be resolved exclusively by the courts located in Australia.

Entire Agreement
